On a human scale ...
A very good time was had by co-op Board Members and at least one other. And why not? They were on the co-op's dime - perhaps dining, taxis and besides - it was all very entertaining for them. There is absolutely no incentive on the part of the co-op to mediate, after all they have the power, the money and access to the co-op's lawyer.
Parties have to sign a Confidentiality Agreement. As no agreement was arrived at, our basement continues to reek - the air quality is absolutely terrible. You see the issue is not about the basement at all - it is about US. If we were to vacate our unit, the co-op would bend over backwards to repair the basement. In fact, it seems like the co-op is hoping the STENCH will drive us away.
Today was a jolly good forerunner to the implementation of Bill 14. The Mediation was held at the Landlord Tenant Board. This is where co-op evictions will be handled - little rooms with round tables - parties separated - co-op Board Members and/or Property Manager represented by co-op lawyers - a winning combination.
We go forward to a Hearing.

I'm not surprised there was no successful mediation. Co-op want nothing unless you/complainant caves completely. After all, they've got the lawyers, they're willing to spend money to thwart any "troublemakers" and they love nothing more than conducting war of attrition.
ReplyDeleteExpect anything and everything from then at Hearing --- especially adjournments if things aren't going their way.
